Dear User, hereinafter referred to as “You” and/or “User”, welcome to the Edraak’s massive open online course (MOOC) platform website, along with our related websites, hosted application, mobile or other downloadable applications (collectively the “Website”), owned by Edraak for Training and Social Development, a non-for-profit Limited Liability Company registered with the Companies Control Department under number (843), wholly owned by Queen Rania Foundation for Education and Development, of address 5 Mohammad Saad AlBatayneh Street, Amman, Jordan (“Us”, “We”, “Our, “Owner”). Please read these Terms of Service (the "TOS") and the privacy policy , the cookies policy and Honor Code prior to creating an account on the Website or using any portion of the Website including accessing any course material, chat rooms, or other electronic services available on the Website. These TOS, the privacy policy and the cookies policy are agreements (may be hereinafter referred to, collectively, as the "Agreements") between You and Us.

BY CREATING AN ACCOUNT ON OUR WEBSITE OR DOWNLOADING, INSTALLING OR OTHERWISE USING OR ACCESSING THE WEBSITE, YOU ACCEPT AND AGREE TO BE LEGALLY BOUND BY THE AGREEMENTS, WHETHER OR NOT YOU ARE A REGISTERED USER ON THE WEBSITE. IF YOU ARE NOT ELIGIBLE TO USE THE SERVICE AS OUTLINED IN THE AGREEMENTS, OR IF YOU DO NOT AGREE TO THE TERMS, YOU DO NOT HAVE OUR PERMISSION TO USE THE SERVICES OFFERED ON THE WEBSITE. On Our Website, you will be able to:

  • Browse courses ("Courses"), programs consisting of a series of related courses ("Programs"), and other content (collectively referred to as "Services") offered by Us, our institutional and individual Partners (as defined below);

  • Create an Account;

  • Sign up to receive more information about Services provided through the Website;

  • Enroll in and access Courses or other Services.

  • Participate in Courses or Programs, including engaging with course content, taking tests, obtaining results and certificates of achievement, and providing feedback after completing a Course or a Program.

  • Your satisfactory completion of a Course, as determined solely by Us or one of our Partners in our sole discretion, may result in the awarding of a verified certificate of achievement ("Certificate") confirming your successful completion of the Course. If you earn a Certificate for each Course in a Program offered through the Service, you will also be eligible to receive a Certificate for the Program.

We offer online courses, authored by colleges, universities and other institutions (collectively, the “Partners”, individually as the “Partner”), that include opportunities for instructor-to-student and student-to-student interactivity, individual assessment of a student's work and, for students who demonstrate their mastery of subjects, a certificate of completion for Our Courses.

ELIGIBILITY

In order for You to be eligible to use Our Services, You must be at least 18 years old. By agreeing to the TOS, you represent and warrant that:

RULES FOR ONLINE CONDUCT

You agree that you are fully responsible for Your own use of the Website and for Your user postings, which would include all content submitted, posted, published or distributed on the Website by You or by other users of the Website, including but not limited to all forum posts, wiki edits, notes, questions, comments, videos and file uploads (the “User Postings”). You agree that You will use the Website in compliance with the Agreements and all applicable laws and regulations, including copyright laws, data protection laws, electronic crime laws, and any laws regarding the transmission of technical data exported from your country of residence. You may not attempt to gain unauthorized access to the Website, other accounts, computer systems or networks connected to any of Our servers through, hacking, password mining or any other means. You may not obtain or attempt to obtain any materials or information stored on the Website, its servers or associated computers through any means not intentionally made available through the Website.

THE FOLLOWING LIST OF ITEMS IS STRICTLY PROHIBITED ON THE WEBSITE:

  • Content that defames, harasses or threatens others in any manner or fashion;

  • Content that discusses illegal activities of any kind under any applicable laws and regulations;

  • Content that infringes Our or a third party’s intellectual property, including, but not limited to, copyrights or trademarks;

  • Profane, pornographic, obscene, indecent, unlawful, confidential or private content;

  • Advertising of any kind or any form of commercial solicitation;

  • Content related to partisan political opinions or activities of any kind;

  • Viruses, trojan horses, worms, time bombs, corrupted files, malware, spyware or any other similar software that may damage the operation of another's computer or property; or

  • Content that contains intentionally inaccurate information or that is posted with the intent of misleading others or disseminating unsupported news or information.

  • Accessing, tampering, or exploiting non-public areas of our Services and Website.

  • Disable, break, interfere or try to circumvent our authentication or security measures or otherwise test the vulnerability of our systems or networks.

  • Encourage or help anyone do any of the strictly prohibited content or actions as described above.

Furthermore, you agree not to scrape, or otherwise download in bulk, any Website content, including but not limited to a list or directory of users on the system, online textbooks, User Postings or user information. you represent and warrant that:

  • You shall not misrepresent or attempt to misrepresent Your identity while using the Website.

  • You shall not download, copy, or use the Services in an manner to infringe on any proprietary rights, including copyrights, patents, trademarks, or trade secret rights, of any third party.

  • You shall not reproduce, transfer, sell, or otherwise misuse any content on the Website or through our Services.

  • You shall comply with all third-party licenses related to the Services and User Postings and have done everything necessary to pass through any required terms granted to end users.

  • Your User Posting does not contain or install any viruses, worms, malware, Trojan horses, or other harmful or security threating content.

  • Your User Posting is not spam, is not machine- or randomly-generated, and does not contain unethical or unwanted commercial content aimed at driving traffic to third-party sites or boosting the search engine rankings of third-party sites, nor does it further unlawful acts (such as phishing) or mislead recipients about the source of the material (such as spoofing).

  • User Posting is not pornographic, libelous, or defamatory, does not contain threats or incite violence against individuals or entities, and does not violate the privacy or publicity rights of any third party.

Any violation of the above list of prohibitions or any other similar violation or breach shall entitle Us to terminate Your use, access and/or participation to the Website without prior notice.

We also reserve Our right to, at Our sole discretion, remove and erase any User Posting that, in Our reasonable opinion, violates any law and regulation or is harmful or objectionable or inappropriate according to our sole judgement and discernment. Such right shall not be interpreted in any way to impose on Us any obligation to remove any User Posting upon User request. The User Posting or any other content on the website is our sole property belonging over which We exert complete control.

By operating and managing the Website, We do not endorse any of the User Postings or claim it to be accurate, useful, or non-harmful. You are responsible for taking necessary precautions to protect yourself and your computer systems from viruses, worms, Trojan horses, and other harmful or destructive content. The Website may contain offensive, indecent, or otherwise objectionable content, as well as content with technical inaccuracies, typographical errors, and other mistakes. We disclaim any responsibility for any harm resulting from the use of the Website by visitors or Account Users and You waive any right you might have as a User to claim compensation for any damage whatsoever resulting from Your use of the Website.

By accessing the Website, you signify that you consent to the collection and processing of your information by Us.

YOUR RIGHT TO USE CONTENT ON THE PLATFORM

All content on the Website is protected Jordanian laws and regulations including, the Jordanian Protection of Copy Rights Law No. 22 of 1992.

Unless otherwise expressly stated on the Website, the texts, exams, videos, images and other instructional materials provided with the Courses and Programs offered on the Website, are for your personal use in connection with those Courses only.

Certain reference documents, digital textbooks, articles and other information on the Website are used with the permission of third parties, and use of that information is subject to certain rules and conditions, which will be posted along with the information. By using this Website, you hereby undertake to abide by all such rules and conditions of use.

You agree to respect the moral right resulting from any copyrighted material and you commit to retain all copyright and other notices on any content you obtain from the Website. All rights related to the Website and its content, if not expressly granted to Us or Queen Rania Foundation for Education and Development, are reserved by Us or the Queen Rania Foundation for Education and Development or under a license granted to Us or the Queen Rania Foundation for Education and Development.

Subject to the Agreements, including these TOS and our privacy policy and Cookies Policy, we grant you a limited, non-exclusive, non-transferable, and revocable license to use our Services and view the content solely for Your personal, non-commercial, and educational purposes exclusively. All other uses or purposes of use are expressly prohibited. As an Account User, upon enrollment in a Course or Program, you are granted a license to access the Course or Program via the Website and Services only.

Courses are licensed to You, not sold. Using our Services does not grant You ownership of any intellectual property rights in our Services or the content You access. This license does not grant you the right to transfer or resell the course in any manner (including by sharing account information with a purchaser or illegally downloading the course and sharing it on torrent sites). You may not reproduce, redistribute, transmit, assign, sell, broadcast, rent, share, lend, modify, adapt, edit, create derivative works of, sublicense, exploit commercially or otherwise transfer or use any course unless we provide explicit permission in a written agreement.

You are granted a license to use our Services and view our content for as long as you have a User Account with Us and until We disable the Course, Program or your User Account pursuant to the Agreements, including these TOS.

USER POSTINGS

  • User Postings Representations and Warranties: Notwithstanding the list of items strictly prohibited on the Website as highlighted above, by submitting or distributing your User Postings, you affirm, represent and warrant (i) that You have the necessary rights, licenses, consents and/or permissions to reproduce and publish the User Postings onto the Website and to authorize Us and other users to reproduce, modify, publish and otherwise use and distribute your User Postings in a manner consistent with the licenses granted by You under these TOS, and (ii) that neither your submission of your User Postings nor the exercise of the licenses granted below will infringe or violate the rights of any third party. You, and not Us, are solely responsible for your User Postings and the consequences of posting or publishing them onto the Website.

  • License Grant to Us: By submitting or distributing your User Postings, you hereby grant Us a worldwide, non-exclusive, transferable, assignable, sub-licensable, fully paid-up, royalty-free, perpetual, irrevocable right and license to host, transfer, display, perform, reproduce, modify, distribute, re-distribute, relicense and otherwise use, make available and exploit your User Postings, in whole or in part, in any form and in any media formats and through any media channels (now known or hereafter developed).

  • License Grant to the Users: By submitting or distributing Your User Postings, you hereby grant to each user of the Website (the “User(s)”) a non-exclusive license to access and use your User Postings in connection with their use of the Website for their own personal or educational purposes.

CERTIFICATES, ETC.

The Partners providing the Courses on the Website may offer a certificate of completion or other acknowledgment (the "Certificate") for students who, in their judgment, have satisfactorily demonstrated mastery of the relevant Course material. The Certificates will be issued by Us under the name of the relevant Partner from where the Course originated. The decision as to whether a Certificate will be awarded to a student who completed the Course will be solely within the discretion of the awarding Partner. The Partner and/or Us may upon providing the Courses on the Website, up to Our sole discretion, choose not to offer a Certificate in relation to some Courses.

No Other Enrollment: When you take any Course through the Website, you will not be an applicant for admission to, or enrolled in, any degree program in any of the authoring Partner’s applicable institution as a result of registering for or completing a Course provided by such institution through Our Website. You will not be entitled to use any of the resources of the Partner beyond the Courses provided on the Website, nor will You be eligible to receive student privileges or benefits provided to students enrolled in degree programs of the Partner’s applicable institution(s).

TRADEMARKS

Use of Our Names, and Trademarks: The "Edraak" name and logo are trademarks of the Queen Rania Foundation for Education and Development. Likewise, the names, logos, and seals of the other participating Partners are trademarks owned by the respective Partner. You may not use any of Our trademarks or any of the Partner’s trademarks, or any variations thereof, without the relevant owner's prior written consent. You may not use any of the Partner’s trademarks, or any variations thereof, for promotional purposes, or in any way that deliberately or inadvertently claims, suggests or, in the Institutions' sole judgment, gives the appearance or impression of a relationship with or endorsement by these Institutions.

All Trademarks not owned by Us, or the other participating Partners that appear on the Website or on or through the Services made available on or through the Website, if any, are the sole property of their respective owners.

Nothing contained on the Website should be construed as granting, by implication, estoppel or otherwise, any license or right to use any trademark displayed on the Website without the written permission of the owner of the relevant trademark.

COMMUNICATION AND NOTIFICATIONS

Push Notifications

These communications aimed and are designed to enhance Your learning experience and keep You informed about the latest updates and opportunities on Our platform.

DISCLAIMERS OF WARRANTY / LIMITATIONS OF LIABILITIES

THE WEBSITE AND ANY INFORMATION, CONTENT OR SERVICES MADE AVAILABLE ON OR THROUGH THE WEBSITE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND (EXPRESS, IMPLIED OR OTHERWISE), INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.,

WE AND OUR PARTNERS ALSO MAKE NO WARRANTY ABOUT THE ACCURACY, COMPLETENESS, TIMELINESS, OR QUALITY OF THE PLATFORM OR ANY COURSES OR CONTENT, OR THAT ANY PARTICULAR COURSES OR CONTENT WILL CONTINUE TO BE MADE AVAILABLE. ““OUR PARTNERS” SHALL MEAN ENTITIES PROVIDING INFORMATION, CONTENT OR SERVICES FOR THE WEBSITE, THE COURSE INSTRUCTORS, THEIR RESPECTIVE STAFF, EMPLOYEES, AND TEACHING ASSISTANTS.

We and Our Partners are not responsible for and do not routinely screen, approve, review or endorse the contents of or use of any of the products or services that may be offered at these other sites. INDEMNIFICATION

You agree to defend, hold harmless and indemnify Us and Our Partners, and their respective subsidiaries, affiliates, officers, faculty, students, fellows, governing board members, agents and employees from and against any third-party claims, actions or demands arising out of, resulting from or in any way related to Your use of the Website, including any liability or expense arising from any and all claims, losses, damages (actual and consequential), suits, judgments, litigation costs and attorneys' fees, of every kind and nature. In such a case, We or one of Our Partners may, in their sole discretion, provide You with written notice of such claim, suit or action.

EXTERNAL SERVICE PROVIDERS

We use third party services to provide various functionalities on the Website. By using and engaging with Our Services, You might have to agree to other third-party service providers Terms of Services and privacy policy .

MISCELLANEOUS

Termination Rights; Discontinuation of Courses and Content: You agree that We, in Our sole discretion, may terminate Your use of the Website or Your participation in it, for any reason or no reason, upon serving notice to you to the effect. It is Our policy to terminate, in circumstances it deems appropriate, Users of the Platform who are repeat copyright infringers. We and Our Partners reserve the right at any time in their sole discretion to cancel, delay, reschedule or alter the format of any Course offered through the Website, or to cease providing any part or all of the Website content or related services, and you agree that neither Us nor any of the Our Partners shall have any liability to you for such an action. If You no longer desire to participate in the Website, you may terminate your participation at any time. The rights granted to you hereunder will terminate upon any termination of your right to Use the Platform, but the other relevant applicable provisions of these TOS or relevant provision in Agreements shall survive any such termination.

Entire Agreement: The Agreements, including these TOS, the Honor Code, the cookie's policy and the privacy policy all together constitute the entire agreement between you and Us with respect to your Use of the Website, superseding any prior agreements between You and Us regarding Your use of the Website.

Waiver and Severability of TOS: Our failure to exercise or enforce any right or provision of these TOS shall not constitute a waiver of such right or provision. If any provision of these TOS is found by a court of competent jurisdiction to be invalid, the parties to the TOS nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision; the other provisions of these TOS shall remain in full force and effect.

Choice of Law/Forum Selection: You agree that these TOS and any claim or dispute arising out of or relating to these TOS or any content or service obtained from or through the Platform will be governed by the laws applicable in the Hashemite Kingdom of Jordan. You agree that all such claims and disputes will be heard and resolved exclusively in the Courts of Central Amman (the Palace of Justice). You consent to the general jurisdiction of the said courts over you for this purpose, and you waive and agree not to assert any objection to such proceedings in said courts (including any defense or objection of lack of proper jurisdiction or venue or inconvenience of forum).

Edraak Honor Code Pledge

COLLABORATION POLICY

By enrolling in a Course on the Website, You are joining a special community of learners. Our aspiration Edraak is to revolutionize education across the Middle East and North Africa (MENA) region in order to create an Arab society that is empowered with a new voice, skills, and mindset. We aspire to achieve its vision by delivering high quality education to the MENA region, and the rest of the world, that is free, accessible, and open to all; You are part of the community who will help Us achieve this goal.

We depend upon your motivation to learn the material contained within the Courses and to do so with honesty. In order to participate in the Courses or use any of our Services through our Website, You must agree to the Honor Code Pledge below and any additional terms specific to a Course. This Honor Code, and any additional terms, will be posted in each Course's content.

THE EDRAAK HONOR CODE PLEDGE

By enrolling in a Course on the Website, User agree that You :

  • Complete all mid-terms and final exams with my own work and only my own work. I will not submit the work of any other person.

  • Maintain only one User Account and not let anyone else use my username and/or password.

  • Update my information on my User Account.

  • Refrain from engaging in any activity that would dishonestly improve my results, or improve or hurt the results of others.

  • Refrain from posting answers to problems that are being used to assess student performance.

Unless otherwise indicated by the instructor of a Course, learners on the Website are encouraged to:

◦ Collaborate with others on the lecture videos, exercises, homework and labs.
